Canada Implements Stricter Penalties for Employers Misusing Temporary Worker Program

Canada has introduced stricter penalties to prevent the Temporary Foreign Worker Program (TFWP) abuse. These measures aim to protect workers and uphold fairness in the labor market. Employers violating program rules face tougher fines, extended bans, and rigorous inspections.  

Starting in the fall of 2024, penalties for non-compliant employers have significantly increased. Fines can now reach $45,000 per violation, compared to the previous $15,000 cap. 

Employers who breach conditions may also face up to five-year bans. Businesses failing operational requirements will be fined $15,000 for each worker affected rather than a single penalty per incident.  

The government has enhanced oversight to strengthen program integrity. High-risk applications are reviewed more carefully during Labor Market Impact Assessment (LMIA) processing and inspections. Employers can no longer rely on attestations from accountants or lawyers to verify their legitimacy. Suspicious activities now trigger immediate suspensions of positive LMIAs.  

From April to September 2024, enforcement measures showed significant results. Employment and Social Development Canada (ESDC) conducted 649 inspections and issued $2.1 million in fines, a notable increase from 2023. Twenty employers were banned, five times more than last year.  

Employers faced heavy penalties for non-compliance. A seafood company was fined $365,750 and banned for two years for failing to maintain records and adhere to hiring laws. A janitorial firm received a $124,000 fine and a five-year ban for violating pay and working conditions. A farming operation was fined $75,000 and banned for five years for refusing inspections and withholding documents. 

Worker protection has also been prioritized. A confidential tip line allows workers to report mistreatment anonymously. Support is available in over 200 languages. To ensure accountability, the government maintains a public list of non-compliant employers.  

These initiatives seek to rebuild trust in the TFWP by tackling exploitation and ensuring equitable practices. While the program plays a crucial role in mitigating labor shortages, any misuse jeopardizes its mission. Canada’s dedication to safeguarding workers and fostering ethical practices highlights the need to uphold integrity within the program.
